Notice period rules in India

  • There is no single legal notice period. Your appointment letter or company policy sets it. In IT, 30, 60 and 90 days are all common; TCS, for example, has had a 3-month notice period since 2016.
  • Buyout: many companies let you pay salary in lieu of notice, but it's usually their choice. A joining bonus from your new employer can sometimes cover it.
  • Can they refuse? The Supreme Court has said resignation is an employee's right (Sanjay Jain v. National Aviation, 2018). The exceptions are pending disciplinary action, or terms in your contract or a valid service bond.
  • Withdrawing: the Supreme Court has also held a resignation can be withdrawn before the employer's acceptance is communicated.

This is general information, not legal advice. Your employment contract and your state's rules apply. For a dispute, speak to a lawyer.

After you resign

  1. Get written acceptance of your resignation and your last working day.
  2. Plan your handover and document your work.
  3. Collect your relieving letter and experience letter.
  4. Check your full and final settlement and gratuity.
  5. Transfer your PF to your new employer instead of withdrawing it.

FAQs

What is the format of a resignation letter?

Date, addressee, subject line, a clear statement that you are resigning, your last working day per your notice period, a thank-you and your name with employee ID.

Can I resign by email?

Usually yes. Most companies accept email resignations, and many also ask you to submit it on the HR portal. Check your company's policy.

What is the notice period in India?

It depends on your contract. 30, 60 and 90 days are common, with 90 days common for experienced IT roles.

Can my company refuse my resignation?

Generally no, according to the Supreme Court, except where disciplinary proceedings are pending or your contract or a valid bond says otherwise.

Should I give a reason in my resignation letter?

It's optional. A short, neutral line like "for personal reasons" or "to pursue a new opportunity" is enough.
